Terms & Conditions

These Terms and Conditions constitute a legally binding contract between the customer ("you") and Pit Stop Tools Pty Ltd (ABN 45 602 260 882) ("Pitstop"), located at 1 / 50 Success Street, Acacia Ridge, QLD, 4110. All orders, purchases, fulfilment, and deliveries of goods ("Goods") from Pitstop are subject to these Terms and Conditions. By purchasing from Pit Stop Tools Pty Ltd you agree to these Terms and Conditions.

Consumer Rights

By making a purchase from the Website, you will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that the Goods must be of acceptable quality, reasonably fit for the purpose that Pitstop represents they will be fit for, and that the Goods will correspond with any relevant description. Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.

Pricing

All prices displayed on the Website are in Australian Dollars and inclusive of GST. Prices for goods are as displayed on the Website, and Pitstop reserves the right to change the prices at any time and without notice to you. Delivery charges are calculated at checkout and subject to change.

Delivery

Risk and title pass to you upon despatch from Pitstop. You accept the estimated delivery times calculated upon checkout are an estimate and subject to delays resulting from stock availability, events outside Pitstop's control, and busy sale periods. You accept Pitstop is not liable to you for any loss, damage, cost or expense suffered as a direct or indirect result of any delay in delivering your purchase.

Cancellation of Orders

Pitstop reserves the right to cancel, at any time before delivery and for whatever reason, an order placed that has been previously accepted. This may be due to, but is not limited to: stock availability resulting from suppliers of your purchased Good(s); Good(s) purchased subject to an error on the Website regarding price, description, or image, and it was not discovered prior to your order being accepted; you have requested your purchased Goods be cancelled; Pitstop is unable to deliver the Goods within a reasonable time as a result of events beyond its control.

Faulty Goods

You are responsible for verifying the goods are what you ordered and not damaged or faulty upon delivery.

Privacy

Pitstop reserves the right to collect, use, and disclose any of your personal information supplied in the process of making a purchase from the Website in accordance with the Privacy Act 1988 (Cth).

Adjustments to these Terms and Conditions

Pitstop reserves the right to amend these Terms and Conditions at any time. Any amendment will take effect from the time it appears on the Website. Whichever Terms and Conditions are present when you purchase from the Website are those that shall apply to you.
